Data protection declaration or information in accordance with Art 13 and 14 DSGVO

Here we inform you about the collection and processing of your data and about your rights.
The legal basis is the Data Protection Basic Regulation (DSGVO) in conjunction with the BDSG.

2. Collection and storage of data when visiting our website
When you call up our website, information is automatically sent to the server of our website by the browser used on your end device. This information is temporarily stored in so-called server log files. The following information is recorded:
 Name and URL of the visited website
 Referrer URL
 Date and time of access
 IP address
 Web browser and the operating system used by your end device
 Domain name
The legal basis for data processing is Art. 6 Para. 1 Sentence 1 lit. f DSGVO. This data does not allow any conclusion to be drawn about your person. These data will not be merged with personal data. However, we reserve the right to check this data subsequently if we become aware of concrete indications of illegal use.
The collection of this data is absolutely necessary to guarantee a smooth connection of the website as well as the comfortable use, delivery and presentation of the contents of our website. In addition, we use this data for the evaluation of system security and stability as well as for statistical purposes, in particular for the optimization of the website, the technology, and our offer.

3. Personal data, use and transmission to third parties
Personal data is any information relating to an identified or identifiable natural person. This includes, in particular, the name, address, e-mail address, telephone number, and gender.
We collect, process and use your personal data only if you consent to the collection, processing and use of data or if another legal basis in accordance with the DSGVO exists.
We use the data you provide us with for contract processing and to process your inquiries, to send you information, advertising material and invitations to our events if you have given your consent, and to receive our newsletter if you have given separate consent. Your data will not be used for other purposes. An exception to this is the use for statistical purposes, provided that the data made available to us is made anonymous.
Your data will only be passed on to third parties if there is a legal obligation to do so if this is necessary for the execution of the contract (e.g. to the transport company commissioned with the delivery and to the credit company commissioned with the handling of payments) or to assert, exercise or defend legal claims, if this is necessary and there is no reason to assume that you have an overriding interest worthy of protection in not passing on your data. Your data will be forwarded exclusively on the basis of the DSGVO. Some third parties to be called in for the execution of the contract have their headquarters outside the territory of the Federal Republic of Germany or process your personal data outside this territory. The level of protection in other countries may not correspond to that of Germany. However, we only transfer your personal data to countries for which the EU Commission has decided that they have an adequate level of data protection or we take measures to ensure that all recipients have an adequate level of data protection, for which purpose we conclude standard contractual clauses.
We use the services of Bohncke GmbH, Auf der Langwies 8 , 65510 Hünstetten-Wallbach , which has access to your data. This service provider is obliged not to use this data for other purposes and to process it exclusively on our behalf and according to our instructions and to comply with the applicable statutory data protection regulations.

4. Duration of data storage and deletion
We will not store the data for the purpose of contract processing for longer than is necessary to fulfill our contractual or legal obligations and to ward off liability claims. Personal data that you have made available to us to receive our newsletter, information, and advertising material or invitations to our events will only be stored until you revoke your consent for this use of your data. If the purpose of storage no longer applies or if a legally prescribed storage period expires, the personal data will be blocked or deleted.

5. Data security
Your personal data is protected by appropriate organizational and technical precautions to protect your data against accidental or intentional manipulation, partial or complete loss, destruction or unauthorized access by third parties. Our security measures are continuously improved in line with technological developments. Nevertheless, Internet-based data transmissions can have security gaps, so that absolute protection cannot be guaranteed.

6. Cookies
Our website uses cookies to make our service more user-friendly, more effective and safer. A cookie is a small text file that we send via our webserver to the cookie file of the browser on the hard disk of your computer. Cookies do not cause any damage to your end device, do not contain viruses, Trojans or other malware. This enables our website to recognize you as a user when a connection is established between our web server and your browser. Cookies help us to determine the frequency of use and the number of users of our website. The content of the cookies we use is limited to an identification number that does not allow any personal reference to the user. The main purpose of a cookie is the (re)recognition of visitors to the website.
In order to optimise user-friendliness, session cookies are used on our website. These are temporary cookies that remain in the cookie file of your browser until you leave our website and are automatically deleted at the end of your visit.
Most browsers accept cookies automatically. However, you can configure your browser so that you are informed about the setting of cookies and can decide individually whether to accept them or to exclude the acceptance of cookies for certain cases or in general and to delete cookies already set. If you deactivate cookies, however, the functionality of our website may be limited.

7. Analysis services
7.1 Google Analytics
This website uses functions of the web analysis service Google Analytics. The provider is Google Inc, 1600 Amphitheatre Parkway Mountain View, CA 94043, USA. We use the function "Activation of IP anonymization" on this website. This means that your IP address will be shortened by Google within member states of the European Union or in other contracting states of the Agreement on the European Economic Area before processing/storage. On behalf of the operator of this website, Google will use this information to evaluate your use of the website, to compile reports on website activities, to measure the campaign performance of online advertising for analysis and optimization purposes.
The processed data includes in particular online identifiers (including cookie identifiers), Internet protocol addresses, device identifiers, location data, identifiers assigned by the customer and user data (in particular time and duration of access, selection of specific offers, etc.). When using Google Analytics, the relationship with the web analysis provider is based on commissioned data processing. The transfer of data to the processor is based on an adequacy decision of the European Commission (self-certification Privacy Shield). The data is deleted regularly (currently every 26 months).

7.2 Google AdWords
We are a Google AdWords customer and have integrated "Google AdWords" on our website, we also use Google Conversion Tracking. This is an internet advertising service that allows advertisers to display ads in Google’s search engine results as well as in the Google advertising network. "Google Adwords" is an analytics service provided by Google Inc, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. Google AdWords sets a cookie (see clause 7) on your end device if you have reached our website via a Google ad. These cookies lose their validity after a maximum of 90 days and are not used for personal identification. If you visit certain pages of our website and the cookie has not expired, Google and we can recognize that you have clicked on a corresponding ad and have thus been redirected to our site.
Each Google AdWords customer receives a different cookie. As a result, cookies cannot be tracked across the websites of AdWords customers. The information collected through the cookie is used to compile conversion statistics for our advertisers. AdWords advertisers know the total number of users who have clicked on their ad and been redirected to a page with a conversion tracking tag. However, they do not receive information that can be used to identify users personally.
If you don’t want to participate in Google conversion tracking, you have the option to opt-out of this use. To do so, you can disable the appropriate Google conversion tracking cookie on your web browser. 8. Social Media-Plugins
8.1 Facebook
Social plugins from Facebook are used on our website. This is an offer from Facebook. The integration can be recognized by the Facebook logo or by the terms "Like", "Like", "Like" and "Share".
If you call up a page of our website that contains such a plugin, your browser establishes a direct connection with the Facebook servers. The content of the plugin is transmitted by Facebook directly to your browser and integrated into the website by it. Facebook may use this information for the purposes of advertising, market research and the design of Facebook pages to meet your needs. For this purpose, Facebook creates usage, interest and relationship profiles, e.g. to evaluate your use of our website with regard to the advertisements displayed on Facebook, to inform other Facebook users about your activities on our website and to provide other services associated with the use of Facebook.

8.2 Google+
Our website uses the "+1" button of Google Plus. This is provided and operated by Google Inc, 1600 Amphitheatre Parkway, Mountain View, CA 94043, United States (hereinafter: Google). When you visit a website of our Internet presence that contains a "+1", your browser establishes a direct connection with Google’s servers. This means that the information that you have visited our website is forwarded to Google.
If you are logged in to Google Plus via your personal user account during your visit to our website, Google can assign the website visit to this account. We have no influence on the extent and content of the data that Google collects with the button. If you click on the "+1" button, this corresponding information is transmitted directly to Google and stored there.
If you wish to prevent such data transmission, you must log out of your Google Plus or Google account before visiting our website.

8.3 Youtube
Our website uses YouTube. This is an internet video portal. YouTube is operated by YouTube LLC, 901 Cherry Ave., San Bruno, CA 94066, USA. YouTube LLC is a subsidiary of Google Inc, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. When you visit one of our websites equipped with a YouTube plug-in, a connection is established to the YouTube servers. This tells YouTube which of our pages you have visited. If you are logged into your YouTube account, you allow YouTube to associate your visit directly with your personal account. YouTube and Google will always receive information about your visit to our website if you are logged in to YouTube at the same time when you visit our website. This happens regardless of whether you click on a YouTube video or not. You can prevent this by logging out of your YouTube account before visiting our website. 9. Google Maps
Our site uses the Google Maps API. Provider is Google Inc, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA.
Google collects, processes and uses data on the use of the map function when using Google Maps. For more information on how we handle user data, please see Google’s privacy policy: https://www.google.de/intl/de/policies/privacy/. There you can also adjust your personal settings in the Privacy Center. The provider of this site has no influence on this data transfer.
The use of Google Maps is in the interest of an attractive presentation of our online offers and easy findability of the places we have indicated on the website. This represents a legitimate interest in the sense of Art. 6 para. 1 lit. f DSGVO.

10. Newsletter and contact form
If you have registered for our newsletter, we will use your e-mail address to send you our newsletter on a regular basis. This data will not be passed on to third parties. A valid e-mail address is required to receive the newsletter. The date on which you subscribed to the newsletter is also saved. We work with the double opt-in procedure.
You can revoke your consent to the storage of data for the receipt of our newsletter at any time and unsubscribe from the newsletter. To revoke your consent, you can use the link included in every newsletter or inform us of your wish to unsubscribe by e-mail to info@bohncke.de.
For questions of any kind, you have the possibility to contact us via a contact form provided on the website or by e-mail. In doing so, it is necessary to provide a valid e-mail address, your name and, if applicable, the company name as well as your telephone number so that we know from whom the inquiry originates, for possible queries and to be able to answer your inquiry. The data you provide will be stored for six months for the purpose of processing your inquiry and in the event of follow-up questions. We will not pass on this data without your consent. If you fill out the contact form, Bohncke GmbH will gain access to your data as an order processor. The data processing for the purpose of contacting us is carried out in accordance with Art. 6 Para. 1 Sentence 1 lit. a DSGVO on the basis of your voluntarily given consent.

11. Online shop and registration
The following data is collected for the purpose of simplifying the purchasing process and for subsequent contract processing: Title, name, address, telephone number, e-mail address, company name, VAT ID, order date, order number, payment method, shipping method, product scope, costs. Furthermore, session cookies can be used to simplify the handling of the purchasing process. The data processed in the session cookie does not contain any personal reference. The data provided by you is necessary for the fulfillment of the contract or for the implementation of pre-contractual measures. Without this data, we cannot conclude the contract with you. There is no data transmission to third parties, with the exception of the transmission of credit card data to the processing bank institutes/payment service providers for the purpose of debiting the purchase price, to the transport company/forwarding agent commissioned by us for the delivery of the goods and to our tax advisor for the fulfillment of our tax obligations.
If the order process via our online shop is aborted, the data entered by you will be stored for at least four weeks and then deleted. In the event of a contract being concluded, all data from the contractual relationship will be stored for the duration of the contractual relationship as well as beyond that, as long as legal claims can be derived from it, and then deleted, unless there are storage obligations going beyond this (e.g. tax law obligations).
During registration your e-mail address and a password will be saved. If a purchase is subsequently made, the e-mail address will be linked to the data collected during the purchase process. The data provided by you is required to set up the customer account. The data processing is carried out for the duration of the existence of the customer account. If the customer account is deleted, the e-mail address and password, as well as the link to the data of the purchase transaction, will be deleted.

12. Google webfonts
In order to display the contents of our website correctly and graphically appealing across all browsers, we use Google Webfonts (script libraries) from Google Inc. (1600 Amphitheatre Parkway Mountain View, CA 94043, USA). The required web fonts are loaded into your browser cache when you call up a page in order to display text and fonts correctly. If your browser does not support Google web fonts or prevents access, content will be displayed in a default font. Embedding the web fonts establishes a connection to the library server. Data (visited website, IP address) is transmitted to Google and saved by Google. 13. Your rights as a data subject
If you wish to exercise one or more of the rights listed below, you can contact one of our employees at any time.

13.1 Right to information (Art. 15 DSGVO)
You have the right to receive free information from us at any time about the personal data stored about you and a copy of this information. You also have the right to be informed of the purposes of the processing, the categories of personal data, the recipients or categories of recipients to whom the personal data have been or will be disclosed, in particular, in the case of recipients in third countries or international organisations, if possible, the storage period envisaged or, if this is not possible, the criteria for determining this period, the existence of a right of rectification or erasure of personal data relating to you or of a right of opposition to such processing by the controller, the existence of a right of appeal to a supervisory authority when the personal data are not collected from the data subject, all available information on the origin of the data, the existence of automated decision making including profiling and, at least in these cases, meaningful information on the logic involved and the scope and intended impact of such processing on the data subject. In addition, as a data subject, you have the right to obtain information as to whether personal data have been transferred to a third country or to an international organisation. If this is the case, you have the right to be informed about the appropriate safeguards in connection with the transfer.

13.2 Right of rectification (Art. 16 DSGVO)
You have the right to demand the immediate correction of incorrect personal data concerning you. Taking into account the purposes of the processing, you may request the completion of incomplete personal data.

13.3 Right to cancellation (right to be forgotten) (art. 17 and 19 DPA)
You have the right to demand that the personal data concerning you be deleted immediately if one of the following reasons applies and insofar as the processing is not necessary for the exercise of the right to freedom of expression and information, for the fulfillment of a legal obligation, for reasons of public interest or for the assertion, exercise or defense of legal claims:
 the personal data have been collected or otherwise processed for purposes for which they are no longer necessary
 They revoke their consent on which the processing was based pursuant to Art. 6 para. 1 letter a DPA or Art. 9 para. 2 letter a DPA, and there is no other legal basis for the processing.
 You object to the processing pursuant to Article 21(1) DPA and there are no overriding legitimate reasons for the processing, or you object to the processing pursuant to Article 21(2) DPA.
 The personal data were processed unlawfully.
 The deletion of the personal data is necessary to comply with a legal obligation under Union law or the law of the Member States to which we are subject.
 The personal data was collected in relation to information society services offered in accordance with Article 8 Paragraph 1 DSGVO.
If we have made the personal data public and our company is obliged to delete the personal data in its capacity as a controller in accordance with Art. 17 Para. 1 DSGVO, we take appropriate measures, including technical measures, taking into account the available technology and the implementation costs, in order to enable other data controllers who publish the personal data to delete them.

13.4 Right to restrict processing (Art. 18 DSGVO)
You have the right to demand that we restrict processing if you dispute the accuracy of the personal data if the processing is unlawful but you refuse to delete the personal data and we no longer need the personal data for the purposes of processing, but you need it to assert, exercise or defend legal claims or you have objected to the processing in accordance with Art. 21 Para. 1 DSGVO.

13.5 Right to data transferability (Art. 20 DSGVO)
You have the right to receive the personal data concerning you which you have provided us within a structured, common and machine-readable format or to request that it be transferred to another person in charge, as far as this is technically feasible and as long as this does not affect the rights and freedoms of other persons.

13.6 Right of objection (Art. 21 DSGVO)
You have the right to object to the processing of personal data concerning you at any time for reasons arising from your particular situation. This also applies to profiling based on these provisions. In the event of an objection, we will no longer process the personal data unless we can demonstrate compelling reasons for processing which are worthy of protection and which outweigh your interests, rights and freedoms, or unless the processing serves to assert, exercise or defend legal claims. If we process personal data for the purpose of direct marketing, you have the right to object at any time to the processing of personal data for the purpose of such marketing. This also applies to profiling, insofar as it is related to direct marketing. If you object to the processing for direct marketing purposes, we will no longer process your personal data for these purposes. You also have the right to object, for reasons arising from your particular situation, to the processing of personal data concerning you which is carried out by us for scientific or historical research purposes or for statistical purposes in accordance with Art. 89, para. 1 of the DPA, unless such processing is necessary for the performance of a task carried out in the public interest.

13.7 Automated decisions in individual cases including profiling (Art. 22 DSGVO)
You have the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning you or significantly affects you in a similar way, unless that decision (i) is necessary for the conclusion or performance of a contract between us, or (ii) is authorised by law of the Union or of the Member States to which we are subject and such law contains appropriate measures to safeguard your rights and freedoms and legitimate interests, or (iii) is made with your explicit consent.
If the decision is necessary for either the conclusion or performance of a contract between you and us or is made with your express consent, we will take appropriate measures to safeguard your rights and freedoms and your legitimate interests, including at least the right to have an intervention by any of us to put forward our point of view and to challenge the decision.

13.8 Right to revoke consent under data protection law (Art. 7 para. 3 DSGVO)
You have the right to revoke your consent once given at any time. As a consequence, we are not allowed to continue the data processing based on this consent for the future. An informal notification by e-mail to us is sufficient for the revocation. The legality of the data processing that took place up to the revocation remains unaffected by the revocation.

13.9 Right of complaint (Art. 77 DSGVO)
You have the right to complain to a regulatory body. As a rule, you can contact the supervisory authority of your usual place of residence or workplace or our headquarters for this purpose:

14. Topicality and amendment of the data protection declaration
This data protection declaration is currently valid and has the status of May 2018. We reserve the right to change this data protection declaration as a result of the further development of our website and offers on it or due to changes in official or legal requirements.
